Terms of Service
The rules that apply when you use kervyra.com, open an account, share content, or place an order.
Last updated: July 25, 2026
How these terms apply
When you browse kervyra.com, open an account, share content, or place an order, these terms form part of the agreement between you and KERVYRA. The policies linked in the website footer belong to the same agreement, so please read them together.
Any consumer right, legal guarantee, remedy, or protection that cannot lawfully be waived stays in place, even if another part of these terms appears to say otherwise.
1. Who you are buying from
KERVYRA is the trading name of the legal business named in our Legal Notice, website footer, and order confirmation. In these terms, “KERVYRA,” “we,” “us,” and “our” refer to that business; “you” means the person using the site or placing the order.
These terms incorporate our Shipping, Order Cancellation, Return, Refund, Payment, Privacy, and Product & Content Disclaimer policies. If information specific to an accepted order conflicts with a general statement here, the order confirmation and applicable mandatory law take priority for that order.
2. Adults only and lawful purchase
KERVYRA is an adults-only store. You must be at least 18, have reached the age of majority, and be legally allowed to view and buy these products where you live. The highest applicable age requirement controls.
A parent or guardian cannot give a minor permission to use this site or buy our products. You are responsible for checking local purchase, possession, import, and use restrictions before ordering, and for keeping your account, order information, and products away from minors.
3. Your account and the details you give us
You may need an account for some features. Give us contact, delivery, billing, and payment details that are current, complete, and accurate, and update them if they change.
Keep your password and security codes private. Tell us promptly if you believe an account or order has been used without permission. We may ask for reasonable verification before changing account details, releasing order information, or processing a sensitive request.
Do not create an account for a minor, impersonate someone else, or use information you are not authorized to use.
4. Product information
Our team checks product descriptions, images, dimensions, materials, compatibility notes, prices, and stock information for accuracy. Screen settings can change how colors appear, and photography may not show every small visual detail. The product page and checkout information available when you order are the main details for that purchase.
Please check dimensions, intended use, care information, and compatibility before ordering. Unless we clearly state otherwise and have evidence for the statement, products are not sold as medical devices and are not intended to diagnose, treat, cure, or prevent a medical condition.
If an important fact in a listing turns out to be wrong, you still have the rights and remedies described in our Return and Refund policies and provided by law.
5. When an order becomes binding
When you submit an order, you are offering to buy the items in your cart under these terms. An automated order acknowledgement means we received the order; it does not yet mean we accepted it.
We accept an order when we send the dispatch confirmation. If items are dispatched separately, each dispatch may form a separate accepted part of the order. Please save the order confirmation and these terms for your records.
A payment may be authorized or collected before acceptance. If we decline all or part of the order after taking payment, we will release the authorization or refund the cancelled amount to the original payment method.
6. Stock, order limits, and resale
Adding an item to a cart does not reserve it. Stock can change before an order is accepted.
Before acceptance, we may limit quantities or decline an order when an item is unavailable; an address cannot be served; payment or identity cannot reasonably be verified; the order appears fraudulent, automated, or unlawful; a product is restricted at the destination; or there is a clear listing or pricing error.
Products are offered for personal use unless we agree otherwise in writing. We may limit orders that reasonably appear intended for unauthorized commercial resale. These controls will not be applied for an unlawful discriminatory reason.
7. Prices, taxes, and clear mistakes
The item price, currency, delivery charge, and any tax collected by us are shown before you submit the order. Import duty, import tax, and carrier handling charges are addressed in our Shipping Policy.
Your bank or payment provider may charge currency-conversion or international-transaction fees that we do not control.
If a price or description contains an obvious error, we may contact you for instructions or decline the affected item before acceptance. We will not increase the price of an already accepted item without your agreement, except where a tax or charge must be corrected by law.
8. Payment checks and fraud review
Available payment methods are the methods shown at checkout. By submitting payment details, you confirm that you are authorized to use the selected method and authorize the applicable charges.
KERVYRA, Shopify, and payment or fraud-prevention providers may check payment, device, address, and transaction signals. An order may be paused while a reasonable review is completed. If verification cannot be completed, we may decline the order and release or refund the payment.
Never send a full card number, card security code, password, or one-time security code to customer service.
9. Promotions, discount codes, and free gifts
A promotion may have its own stated dates, eligibility, item limits, or other rules. Unless the promotion says otherwise, codes cannot be exchanged for cash, combined, copied, resold, or applied after an order is submitted.
Before an order is accepted, we may refuse or correct a discount obtained through a technical error, manipulation, or use outside the published promotion rules. If that changes the amount due, we will show or explain the corrected total and let you decide whether to continue.
10. Shipping, delivery, and delays
Processing targets, delivery estimates, tracking, address changes, customs, and import charges are explained in our Shipping Policy. Delivery dates are estimates unless we expressly promise a fixed date.
If we learn that we cannot dispatch within the time we promised, we will notify you and provide the delay or cancellation choices required by applicable law. Where required, you may agree to the revised timing or cancel the unshipped item for a full refund.
Please provide a complete, deliverable address and check it before paying. Responsibility for loss or damage passes only at the point permitted by applicable law; nothing here transfers carrier risk to a consumer earlier than the law allows.
11. Cancellations, returns, and refunds
Our Order Cancellation, Return, and Refund policies explain the steps, timing, evidence, return authorization, and payment processing that apply.
Because these are intimate products, a change-of-mind return normally requires the item to be unused and the hygiene seal to remain intact. The hygiene exception applies only when the product was genuinely sealed for health or hygiene protection and was unsealed after delivery.
A broken seal does not remove rights that apply when an item is faulty, damaged, unsafe, incorrect, or materially different from its description.
12. Product use and care
Use a product only as described on its product page and in any instructions supplied with it. Inspect it before use, follow the stated cleaning and storage guidance, and do not use a damaged product.
Individual experience varies. Stop using a product if it causes injury, severe or persistent pain, bleeding, numbness, an allergic reaction, or another concerning symptom, and seek appropriate professional help.
Our Product & Content Disclaimer contains additional use, care, and educational-information limits. It does not reduce rights relating to a defective or unsafe product.
13. Reviews, photos, and other content you share
If you submit a review, photo, suggestion, or other content, it must be honest, relevant, lawful, and yours to share. Do not include another person's personal information, content involving a minor, malicious code, or material that infringes another person's rights.
You keep ownership of your content. You give KERVYRA a non-exclusive, worldwide, royalty-free license to host, reproduce, translate, format, and display it for operating and promoting KERVYRA, for as long as the content is used, subject to applicable privacy and consumer law.
We may reject or remove content that violates these terms, is deceptive, is unrelated to the product, or creates a legal or safety risk. We will not suppress a review merely because it expresses a genuine negative opinion.
14. KERVYRA content and intellectual property
The KERVYRA name, logos, original product designs, text, photographs, graphics, video, and website arrangement belong to KERVYRA or its licensors and are protected by applicable intellectual-property laws.
You may view and use the site for personal, non-commercial shopping. Without written permission, you may not reproduce, scrape, publish, sell, modify, or commercially exploit our content. Names and marks owned by others remain the property of their owners.
15. Prohibited uses
You must not use the site or its content to:
• break a law or help another person do so;
• enable a minor to access adult products or adult-only areas;
• impersonate someone, submit false information, or misuse another person's payment or personal information;
• harass, threaten, exploit, discriminate against, or violate the rights of another person;
• upload malware, probe restricted systems, bypass security or age controls, or interfere with checkout or store operation;
• scrape, crawl, harvest data, spam, phish, or run automated purchasing tools without written permission;
• infringe intellectual-property, privacy, publicity, or other legal rights; or
• purchase for unauthorized commercial resale or evade lawful product, quantity, location, or payment restrictions.
We may block the relevant activity or access and preserve evidence where reasonably needed to protect customers, the store, or legal rights.
16. Third-party services and links
Shopify hosts our store. Payment methods, carriers, review tools, and other providers may supply parts of the shopping experience. Their own terms may apply when you choose their service.
Links to an external website do not mean we control or endorse everything on that site. Please review the external provider's terms before using it.
Using a provider does not remove KERVYRA's responsibility for an accepted order where the law places that responsibility on us.
17. Website updates, mistakes, and downtime
We may maintain, update, suspend, or discontinue a website feature or product listing. A change to the website does not alter an order we have already accepted unless you agree or the law requires it.
We may correct typographical, technical, stock, price, promotion, delivery, or product-information errors. If a correction materially affects an accepted order, we will provide the information and remedy required by applicable law.
We do not promise that the site will always be uninterrupted or error-free, but we will take reasonable steps to restore service and protect checkout and account functions.
18. Legal guarantees that remain yours
Products must meet the description and any legal guarantee of conformity, quality, or safety that applies to your purchase. These rights exist whether or not they are repeated in these terms.
Apart from express product-page promises and rights that cannot be excluded, general website information is provided for shopping and educational purposes. Personal preferences and results vary, and we do not guarantee a particular sensation, outcome, or suitability for an unstated purpose.
Nothing in this section turns a defective product into an “as is” sale or excludes a remedy the law gives you.
19. Limits on our responsibility
Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, gross negligence where applicable, death or personal injury caused by negligence, or a defective product where mandatory law provides otherwise.
For a consumer purchase, we are responsible for reasonably foreseeable direct loss caused by our breach. We are not responsible for a loss caused by your unlawful use, failure to follow clear instructions, or an event outside our reasonable control, to the extent the law permits.
We do not accept liability for business interruption, lost profit, lost revenue, or other commercial loss arising from a purchase made as a consumer. Where the law permits a monetary cap for another type of claim relating to an order, the cap will be the amount paid for the affected order. The first paragraph of this section always takes priority.
20. Delays outside reasonable control
We are not responsible for a delay or failure caused by an event we could not reasonably prevent or control, such as a natural disaster, epidemic, war, civil disturbance, government action, customs closure, carrier network failure, major power or internet outage, or labor disruption.
We will take reasonable steps to reduce the effect, keep you informed, and resume performance. If the event creates a material delay, you may use any cancellation or refund right provided by applicable law or our policies.
21. Suspension and termination
You may stop using the site at any time. We may suspend or end access when reasonably necessary for security, fraud prevention, legal compliance, or a serious or repeated breach of these terms.
Suspension does not cancel an accepted order unless we separately notify you and provide any required refund. Clauses that by their nature should continue, including payment obligations, intellectual property, liability, and dispute provisions, survive termination.
22. How this agreement works
If a court or authority finds part of these terms invalid or unenforceable, the rest continues to apply, and the affected part will be limited only as much as needed. A delay in enforcing a right is not a waiver of that right.
We may transfer our rights or obligations as part of a genuine reorganization, financing, merger, or sale, provided this does not reduce your rights. You may not transfer an order or account in a way that creates fraud, resale, or legal risk without our consent, but this does not restrict a right that local law allows you to transfer.
These terms and the policies incorporated into them are the agreement about use of the site and purchases from KERVYRA. Electronic order confirmations and notices may be used where the law permits.
23. Governing law, complaints, and future updates
These terms are governed by the laws of Wyoming, United States. This choice does not remove mandatory consumer rights or access to courts or authorities available where you live.
If something goes wrong, contact us through the Contact Us page or reply to the order confirmation. Include the order number and a clear description so we can investigate. You may still use any court, regulator, payment dispute, or alternative resolution process available under applicable law.
We may update these terms for future site use and future orders when our services or legal duties change. The version in effect when an order is accepted continues to govern that order unless a change is required by law or you agree otherwise.
The final legal business name, address, and contact details are provided in our Legal Notice and website footer.
